Probate is a judicial certificate confirming that a Will is genuine and confers on the executors the power and authority to gather the assets, pay the debts and distribute the remainder of the estate to those named.
When you apply for probate, you are assuring the Probate Court that you will deal with (‘administer’) the estate as set out in the Will and according to law.
When there is no Will or the legal document has failed due to it being incorrectly drafted, signed or damaged then ‘Letters of Administration’ need to be applied for, as the rules of intestacy will apply. Anyone who dies without a Will is termed as dying ‘intestate’.
